Section 68 of the OEC requires that "a party is declared by final decision of a competent court guilty of or found by the Commission of… spent in his election campaign an amount in excess of that allowed by this Code… shall be disqualified from continuing as a candidate or if he has been elected, from holding the office."
Earlier this year, the Supreme Court voted 12-0 and junked E.R. Ejercito's motion that questions the decision of Comelec that disqualifies him as Laguna's governor due to his over spending last 2013 elections.Comelec Chair, Sixto Brillantes stated that Ejercito spent more than 20 million on advertisement that aired in ABS-CBN during the campaign period. It is stated in our election rules that since Laguna has 1.5 million registered voters he is only allowed to spend 4.5 million pesos for his entire campaign. Liberal party candidate for governor, Edgar San Luis, provided a documentary that will show the list of expenses that E.R. aquired during the election campaign.
At first, the encumbent Governor of Laguna, Ejercito, did not follow the order of the Comelec and stayed on his office despite of the order to move out. But with the help of his uncle , Erap, he was convinced to vacate his office. He also stated that President Aquino is really againts the Ejercitos. First, Jinggoy was jailed because of graft and corrupton, and now, E.R. was moved out of his office. In my own poiny of view, what P-Noy is doing is just. Being the president, he is bound to do what is right and for the benefit of the oppressed and his country.
Yes, E.R. is very well loved governor, but what he has done was against the law. Since the law is the rule of conduct, just and obligatory, he shall oblige it. Besides, its not the end of the world. He can still rum for the next election and do his passion, to serve the public. Next time he shall observe the law. Public service is not a business, its passion. Money cannot buy everything.
