The Supreme Court upheld the decision made by Comelec disqualifying ER Ejercito for violating Section 68 of the Omnibus Election Code thru overspending during 2013 midterm elections.
Comelec proved strict implemetation of rules especially for violations in campaigning during election by correctly finding ER Ejercito disqualfied for violating rules. While ER Ejercito tried to prove his claim and stood firm as still the Governor of Laguna, the SC gave him sufficient reason to step down and face the consequences of the violation. His supporters proved their part already for standing for him until his last move to defend his seat for Laguna people.
SC has again proved its power by enforcing the laws even against powerful people who even with good and clean intentions for the people commited violations in the process.
Election as the most evil period where politicians commit various violations and are exposed to danger or threat. Voters are bribed and being threathen for their vote in return. Candidates are killed and all sorts of blackmailing and libelous acts are committed from one candidate or party against another. Today, election has been an arena and cock pit where families destroy or ruin other family. An avenue to find who really are your allies, enemies, relatives and a true friend.
My observation is that, election is about and a matter of power and trust. Power comes with money and trust is elusive. One cannot be powerful without money and money defines the process of winning. Trust and betrayal becomes synonymous. Friends and relatives become enemies and strangers. Indeed, election changes everything.
It is found that ER Ejercito spent P23,563,365.28 for his campaign versus the authorized amount which is P4,576,566 or P3.00 per person only. It reflects how money helped him win during the election. And this is because of power for more power. He later on questioned and doubted Pnoy’s administration, thus a stained trust of his governance.
Every election, violence and violations is getting worst. Why would a candidate spend fives times more than the authorized amount and for what? Of course, after winning, these people will steal more than their expenses, a corruption and malversation of public fund. Again, people are deprived of the money they are supposed to enjoy.
I am in favor of ER’s disqualification. Failure to comply with the rules should be disqualified to give him lesson as well to other violators. It’s time to enforce the law against violators and give the seat to those who are more deserving. This will set the standards on strict enforcement of rules during elections and to candidates. To lessen violence, abuse and other acts which may cause danger in the society.
The people should as well help the the government by reporting illegal acts during election. ER Ejercito should also accept the decision without questioning or doubting the intention and purpose but must look on the legal aspect and true intent of the law to stabilize imbalances and illegality of every act in the society. It may be harsh he being disqualified, he cannot question the same for if have faithfully complied with the rules, he can not be disqualified and must have been service his people until now.
